5-10-16 fdl judge blocks campbellsport area proposed sand mine

A Fond du Lac judge has blocked a proposed sand mine in the town of Ashford.  Judge Peter Grimm has voided a special use permit that would have allowed Baztler Trucking of Campbellsport to mine property across the road from a town subdivision.  A group of residents had filed suit after the Ashford Board of Appeals approved the permit last year.  Fond du lac County Planner Sam Tobias says he can understand the property owners’ frustration. “Those folks are probably within a quarter mile of this proposed sand a gravel site, and they’re understandably upset.  The noise, the dust, the truck traffic,”  Tobias told WFDL news.  The judge ruled that the appeals board failed to act according to the law when it approved the special use permit.  Tobias says for town appeals boards it can be a real balancing act between mining interests and disruption of the residents.
